1. Introduction
Welcome to Lotto Nuts, which includes everything on the site - content, trademarks, and services (together, the “Site”). This Site is operated by Rosebury Limited, a company registered under the laws of the British Virgin Islands.
Each a “Party”, together “Parties”.
These Terms Of Use (“TOU”, along with our Privacy Policy and Cookie Policy, collectively the “Terms”) form a legal agreement between you (“user”, “you”, “your”) the visitor or registered user of the Site - and Rosebury Limited (“Rosebury”, “the Company”, “we”, “us”, or “our”). By signing up to register and using our Services, you're agreeing to these Terms. If you ever disagree with them, you must stop using the Site.
We reserve the right to change these TOU including any of the Services at any time. Should there be any material changes to these TOU, you will promptly be notified of such changes and prior to accessing and using your account for the first time after such changes take place you will be required to expressly re-confirm your acceptance of these TOU. In the event that, following any possible changes, you not wish to continue using the Services anymore, you may withdraw your available funds and close your Account.
In the event of minor, non-material changes to these TOU, we will endeavor to promptly notify you any such changes, however we cannot guarantee that at all times we will be able to. You are encouraged to periodically review these TOU, also by checking their date above, to ensure you are referring to the latest available version.
These TOU may be published in a number of other languages. In the event of any discrepancy between the English version and versions in other languages, the English version shall prevail.
2. Legal Status
Rosebury is a gaming company, authorised to offer lottery courier services (“Lottery Services”) and real-money skill-based games (“Skill Games”), together (“Services”).
We act as an independent ticket purchasing service and are not affiliated with or endorsed by Multi State Lottery Association or any official lottery organizations.
3. Eligibility and Legal Use
You must be at least 18 years old (or older, depending on your local laws) to use our Site and Services. If we discover that you are underage, we may close your Account and withhold any associated Winnings.
It’s your responsibility to ensure you’re legally allowed to use our Services from your location and that you’re doing so in line with our Responsible Gaming Policy (Clause 18) and all applicable prevailing laws and regulations.
Our services are intended strictly for personal entertainment, not for commercial use.
4. Using the Site
Rosebury provides:
Information on official U.S. lotteries: Powerball and Mega Millions, together or individually the “Lottery Operator(s)”.
A platform for registered users to buy lottery tickets (“Lottery Tickets”) through our courier service.
A variety of Skill Games: including without limitation: arcade games, card games, puzzles, word and trivia games.
As long as you follow the Terms and all applicable laws and regulations in your jurisdiction, we give you permission to use the Site. However, you're not allowed to:
Copy or share content without permission.
Modify or resell our content.
Interfere with our network or system security.
Use bots or automated tools to access the Site.
Send spam or unauthorized messages.
Use the Site for any fraudulent, dishonest or unlawful purposes.
Any rights not specifically granted to you remain with and are retained by Rosebury.
5. Creating an Account
To use the Services, you must create a personal account (“Account”) by providing required personal information. If you choose not to, you won’t be able to register on the Site. By registering, you confirm that:
You’re an individual acting for yourself only.
You’re legally able to enter into this agreement.
You’re not acting on behalf of someone else.
Your funds come from legal sources.
You’re using valid payment methods.
You agree to our Terms.
You must keep your Account info up-to-date and accurate. Providing false info may result in your Account being closed and funds withheld.
We’ll verify your contact details and may suspend your Account if we can’t confirm them. Your login details must be kept secure, and you’re responsible for all and any activity on your Account.
All personal information you provide to us will be treated in accordance with our Privacy Policy.
If you’re associated with Rosebury’s operations, or reside in a country or jurisdiction where our Services are restricted or prohibited, you’re not allowed to create an Account or use our Services.
It is solely your responsibility to ensure that you are not violating any laws or regulations applicable in your country or jurisdiction by accessing or using our Services. Rosebury will not be held liable for any consequences that arise from your access or participation in violation of such laws.
By using our Services, you confirm that you are acting in full compliance with your local laws. If you are unsure about the legality of your participation, you must seek independent legal advice before proceeding.
6. Managing Your Account
We manage your Account, including funds on hold and winnings from Lottery Tickets and Skill Games (“Winnings”). Unless proven otherwise, our calculations are final.
Each user may only have one active Account and Accounts don’t earn interest on balances.
We reserve the right to:
Deny or close Accounts without giving a reason.
Decline deposits or suspend Accounts for verification.
Confiscate funds or deny claims if you violate the Terms.
Block access to the Site and promotions if we suspect fraud or abuse or any dishonest activity.
Monitor your activity on the Site.
You must notify us immediately of any unauthorized use of your Account. We shall not be liable for any such unauthorized use of your Account other than due to our fault. For the avoidance of doubt, if one or more Lottery Tickets are purchased or Skill Games played using your login details it will be deemed to have been made by you and therefore shall be accepted as valid.
7. Depositing Funds
To use the Services, you’ll first need to add funds to your Account. You can do this by choosing one of the available payment methods listed on our Site. Simply click the “Deposit” button in your Account and follow the on-screen instructions.
We may update, change or remove deposit options at any time without prior notice and may place limits or conditions on certain payment methods. Not all options are guaranteed to be available in all locations or at all times.
When you make a deposit, it is your responsibility to ensure all payment details are accurate. We are not responsible for delays or losses caused by incorrect or incomplete information.
If you're using our subscription service, you authorize us to collect recurring payments from your selected payment method until you cancel.
Unless clearly stated otherwise, all deposits are non-refundable. If you believe you’ve been charged incorrectly, please contact our support team with full details. If we find an error on our end, we’ll issue a refund which you agree and acknowledge is the only available remedy.
8. Withdrawing Funds
You can withdraw the available balance in your Account at any time, provided it meets our withdrawal requirements.
To do this, head to your Account, and click the “Withdraw” button, choose your preferred method, and follow the on-screen instructions. We’ll send your funds to the wallet or account you specify.
Please note:
You can only withdraw your winnings from Lottery Ticket or Skill Games - you cannot withdraw deposits.
Bonus funds cannot be withdrawn unless stated in a specific promotion.
We reserve the right to request identity before approving a withdrawal.
It’s your responsibility to report and pay any taxes on your Winnings. In some cases, local tax laws may require us or the Lottery Operator to withhold a portion of your prize before payment. You hereby acknowledge and accept any such deductions made.
9. Our Services
We offer different types of lottery-related services and Skill Games:
9.1 Lottery Ticket Service
We act as a courier, buying official Lottery Tickets for lottery draws (“Lottery Draws”) on your behalf from Lottery Operators. Once purchased, we scan and upload a copy to your Account as proof of purchase. These Lottery Tickets are stored securely and remain your property.
We collect Winnings for you and credit your Account (after deducting any applicable fees or taxes) in the case of Winnings from Lottery Tickets or credit such Winnings to your Account immediately in the case of Winnings from a Skill Game.
Lottery Draws are performed by the relevant Lottery Operators. Your participation in each Lottery Draw is subject to the terms and conditions of the relevant Lottery Operator. By placing a request to purchase Lottery Tickets (“Purchase Order”) you agree to comply with the relevant, applicable rules of such Lottery Operators.
9.2 Subscriptions
You may subscribe to recurring orders (e.g., weekly Lottery Draws), which we will automatically renew and charge your Account unless and until you cancel. We’ll notify you if any payment fails, and we may pause your subscription until it's resolved.
9.3 Skill Games
Each Skill Game’s rules, stake (including any service fees) and prizes are displayed on the game section of the Site.
Winnings from Skill Games will be transferred to your Account. You expressly acknowledge and agree that such Winnings may be subject to taxes, charges, withholdings and other deductions and you will be solely and wholly responsible to report and pay all applicable taxes, charges, withholdings, and deductions.
We reserve the right to discontinue or to alter all or any Skill Games formats, or add new Skill Games at our sole discretion, without providing reasons. You acknowledge that:
a) When entering the Site and participating in the Skill Games provided, you do so at your own risk.
b) We shall not be responsible or incur any liability for any downtime, server disruptions, lagging, or any technical or political disturbance to any of the Skill Games. In the event of a malfunction, all Skill Games are void. Refunds may be given solely at our discretion.
c) If there is (or if you are later notified) that there is or has been a malfunction in any Skill Game or its interoperability, any stake made during such malfunction shall be deemed invalid and the result, null and void, regardless of whether Winnings have been paid out. Winnings obtained in respect of a malfunctioning Skill Game shall remain our property.
9.4 Lottery Pools
“Private Lottery Pool” means any group of Lottery Tickets ordered by individual users for which prizes will be shared;
“Pool Member” means any user that contributes a Lottery Pool Ticket to a Lottery Pool;
“Lottery Pool Ticket” means any Ticket contributed to a Lottery Pool;
“Lottery Pool Creator” means any user that creates a Lottery Pool;
“Lottery Pool” means any lottery pool in which only members of a private group may become Pool Members.
Users may elect to participate in Private Lottery Pools, and may group Lottery Pool Tickets with other users in any single Private Lottery Pool in order to share prizes, subject to the following terms and requirements:

In order to participate in a Private Lottery Pool, a user must be invited by a Lottery Pool Creator and become a Pool Member;
Winning Lottery Pool Tickets whose total prize value up to $600 will be redeemed by us on behalf of the users just as with Lottery Tickets that are not part of a Lottery Pool. The total value of Winnings will be divided among the Pool Members in accordance with the Pool Terms & Prize Sharing Agreement.
We, in our sole discretion, may rename any Private Lottery Pool if we consider its name to be offensive to other users.
9.5 Prize Money Handling
We will credit wins from Lottery Tickets or Lottery Pool Tickets directly to your Account.
10. Bonus Programs
From time to time, we may offer bonus funds, discounts, or promotional credits (“Bonuses”). All Bonuses are subject to these TOU and to their specific terms and conditions which will be provided along with the description of each promotion. It is your sole responsibility to ensure that you have fully read and understood the relevant terms and conditions prior to the acceptance of any Bonuses.
Unless stated otherwise, all Bonuses are subject to the following:
Bonuses can’t be withdrawn.
They may expire if not used within a certain time (as specified).
Only one Bonus offer is allowed per person or household unless we state otherwise.
We reserve the right to cancel or change promotions at any time. If we suspect abuse (like creating multiple Accounts or exploiting a glitch), we may remove the Bonus and withhold Winnings.
11. Order Processing and Lottery Ticket Ownership
Once you place a request to purchase a Lottery Ticket(s) (“Purchase Order”), it will be processed based on your chosen Lottery Draw(s). Your Purchase Order confirmation is not a guarantee that your ticket was successfully purchased. A Lottery Ticket is considered valid only once:
We’ve successfully processed your payment; and
We upload a scanned Lottery Ticket(s) to your Account before the Lottery Draw.
We cease to accept Purchase Orders a certain number of hours prior to the undertaking of the relevant Lottery Draw (“Cut-Off Time”). The amount of time remaining until the Cut-Off Time for each Lottery Draw is displayed on the Site. We, in our sole discretion, determine the length of the Cut-Off Time. Once the Cut-Off Time for a particular Lottery Draw has expired, you will no longer be able to submit a Purchase Order.
We reserve the right to decline, refuse or limit any Purchase Orders and/or to decline or refuse to provide or limit the provision of, any Services. No charge will be made for any Purchase Order which is not accepted.
You agree that your Purchase Order and payment are final and cannot be cancelled or refunded (except as expressly set out in these TOU). In the event of differences between the numbers appearing on a Purchase Order and a Lottery Ticket, the Lottery Ticket numbers will prevail.
If for any reason we’re unable to purchase your Lottery Ticket, we’ll refund your Purchase Order. You acknowledge that you have no other claim against us other than a refund of your Purchase Order. You agree that the Company is not responsible for any losses if an order fails due to any technical reasons or third-party issues.
All Lottery Tickets remain your property, even though we physically store them. We will never claim or acquire any rights to your Lottery Tickets or Winnings beyond what’s needed to fulfil our Services.
12. Winning Tickets and Prize Payments
The number of winning numbers that you need to obtain for entitlement to Winnings in connection with a Lottery Draw together with the prize amount are displayed on our Site.
Winnings up to $600 from Lottery Draws are automatically credited to your Account once the results are confirmed. Winnings from Skill Games are credited to your Account instantly after the game ends.
For larger lottery prizes, we’ll handle the prize claim process on your behalf - just like you would if you were claiming it in person in the U.S. Once the claim is processed, your Winnings will be deposited into your Account. This typically takes two weeks.
You expressly acknowledge and agree that when we collect and transfer the Winnings to your Account it will be after the Lottery Operator deducts taxes, withholdings, or other sums from the amount of the prize in accordance with its Lottery Operator’s rules. It’s your responsibility to report and pay any local taxes on your winnings, if necessary.
13. Limited Power of Attorney
By using our Lottery Services, you agree to grant us a Limited Power of Attorney that allows us to act on your behalf strictly for the purpose of handling your Lottery Ticket purchases and the collection on your behalf of any Winnings over $600.
You authorize us to act in your name and on your behalf solely for the following activities:
Purchasing Lottery Tickets in accordance with your Purchase Orders.
Taking possession (but not ownership) of your Lottery Tickets and sending you a scanned copy of such Lottery Ticket(s).
Storing your Lottery Tickets in a secure facility until the applicable draw.
Redeeming your winning Lottery Tickets, collecting Winnings.
Depositing Winnings from Lottery Tickets directly into your Account.
This limited authority begins each time you place a Purchase Order and continues for as long as necessary to redeem any associated Winnings and depositing them into your Account.
14. Inactivity and Account Closure
If you don’t log in or use your Account for 12 consecutive months, we will mark it as inactive and have the right to close it. We’ll attempt to contact you before doing so.
Before closing your Account, we’ll return any remaining funds to you, provided we’ve verified your identity and there are no ongoing disputes or outstanding or pending legal issues.
15. Intellectual Property and Relationship of the Parties
Everything on Site - including text, logos, graphics, and software - is either owned by or licensed to us and protected under intellectual property laws.
You’re allowed to use the Site for personal, non-commercial purposes only. That means you can view, download, and print content for your own use - but you may not:
Copy, reproduce, or share it elsewhere.
Alter, reverse-engineer, or create derivative works.
Use our trademarks or branding without permission.
If you believe your intellectual property rights are being violated on our Site, please contact us so we can investigate and respond appropriately.
You agree that no joint venture, partnership, or employment relationship exists between you and us as a result of these TOU. You agree not to hold yourself out as representative, agent, operator, distributor, or employee of us and that we shall not be liable for any of your representations, acts, or omissions.
16. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, officers, employees, or agents will not be liable for:
Any indirect, incidental, or consequential damages, including without limitation, loss of profits, business, earnings, revenue or savings any physical, emotional, distress or mental injury or suffering.
Loss of Winnings due to technical failures or third-party disruptions relating to its Services.
Delays or failures in lottery results publication or ticket processing.
Errors in Lottery Draw results as reported by third-party sources.
Missed Lottery Draws due to user error or late orders.
Any losses caused from the misuse or unauthorized use of usernames and/or passwords.
You accept that we shall not be liable for any delay or failure to perform our Services resulting from Force Majeure events beyond our reasonable control, including, without limitation, extreme weather, acts of God, natural catastrophes, war, civil unrest, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, computer viruses strikes, or shortages of transportation facilities, transportation stoppages or slowdowns, and stoppage or slowdown of the Internet or other networks.
Our total liability to you for any claim related to your use of our Services will not exceed the total amount you paid to us in the six months before the claim arose.
You use our Services at your own risk. We don’t assure, warrant or guarantee that the Site will be error-free, always available, or secure.
17. Lottery Operators
We do not guarantee that any Lottery Operator will perform (including properly) any Lottery Draw, honour a Lottery Ticket and/or, pay applicable Winnings, and you agree that we will not be responsible for the failure of any Lottery Operator in connection with any of the foregoing activities. In no event will we be required or liable to pay you any Winnings or amount equal to the Winnings, in the event that a Lottery Operator fails to do so for any reason. You hereby waive any legal or equitable claims, rights or remedies you may have against us or anyone acting on our behalf that arises from your interaction with a Lottery Operator and/or the actions or inactions of a Lottery Operator.
18. Third Party Links
The Site may contain links to third party websites that are not owned or controlled by us. We have no control over, and assume no responsibility for the content, privacy notices, or practices of any third-party websites. You expressly release us from any and all liability arising from your use of any third-party website. We encourage you to read the terms and conditions and privacy notices of each third-party website that you may choose to visit.

When submitting a complaint or enquiry, please include clear information regarding your usernames and all relevant details relating to your enquiry or complaint. We will endeavor to respond as quickly as possible and will do so within 10 business days from the date on which the complaint was submitted to us.
20. Responsible Gaming Policy
Rosebury Limited is committed to responsible gaming, and in this regard we: (i) use best endeavors to prohibit anyone under the age of 18 years (or the applicable age in the relevant country) from registering an Account and using our Services; (ii) recommend that all users establish limits for participating in Lottery Draws and purchasing Skill Games; and (iii) do not recommend that users perceive Lottery Tickets or Skill Games as a source of income or as a way to recoup debt. If you feel that you are using our Services in an irresponsible way, we encourage you close your Account include the following:
You may, at your discretion, choose to limit the amount you may deposit during a specific period of time.
You may at your discretion choose to set a maximum session time during which you may be logged in at the Site. After this period has expired, you will be logged out of the Site and any game in progress is stopped.
You may at your discretion choose to set a time-out for yourself for a period of one day up to six weeks, as per the functions within the Site. During this time, you will be unable to play or make a deposit, order, or a purchase.
You may at your discretion choose to exclude yourself from playing for a definite or an indefinite time, as per the functions within the Site, during which period you will not be able to access your Account.
If you wish to increase an exclusion or decrease a financial limit, these shall become effective immediately upon receipt of notification. If you would wish to increase a financial limit set by you, such change shall only take place twenty-four (24) hours after the request has been received.
21. Indemnification
You agree to indemnify and hold the Company harmless from any claims, damages, or legal expenses resulting from:
Your breach of these TOU.

Any content or data you submit that violates third-party rights.
Your failure to comply with any laws or regulations in your jurisdiction.
If you are obligated to provide indemnification hereunder, the Company may withhold any payment it is otherwise required to make to you to offset your indemnity obligations.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of the British Virgin Islands. If any provision of these TOU is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these TOU, which shall remain in full force and effect.
No waiver of any term of these TOU shall be deemed a further or continuing waiver of such term or any other term, and a Party's failure to assert any right or provision under these TOU shall not constitute a waiver of such right or provision.
Any disputes that can’t be resolved informally will be submitted to binding arbitration or small claims court, depending on your local rights. Arbitration will:
Be confidential.
Use a neutral arbitrator.
Be held in the jurisdiction we specify (unless local laws allow otherwise).
You waive the right to a jury trial or to participate in a class-action lawsuit, unless prohibited by your local laws.
23. Changes to These TOU and Assignment
We may update these TOU from time to time. If the changes are significant, we’ll notify you via email or on the site before they take effect.
By continuing to use the Site after changes are posted, you agree to the revised TOU.
We encourage you to check this page regularly for updates. These TOU, and any rights and licenses granted hereunder, may not be transferred, or assigned by you but may be assigned by us without restriction or notification to you.
24. Entire Agreement
These Terms constitute the entire agreement between you and us and supersede all and any prior understandings, agreements, representations and warranties, both written and oral, with respect to the Site and Services. Nothing in the TOU, express or implied, shall be deemed to confer any rights or remedies upon, nor obligate any of the parties hereto, to any person or entity other than such parties, unless so stated to the contrary.
